This Terms of Agreement is entered into between OnMyWayAuto and the customer for automotive
repair and related services. The terms and conditions of this Agreement are as follows:
- Scope of Work: OnMyWayAuto agrees to perform the necessary
automotive repairs and services as agreed upon with the Customer.
The specific details of the repairs, including the description of services,
parts to be replaced, and estimated costs, will be documented in the
repair order.
- Authorization: By signing this Agreement, the Customer authorizes
the
Company to perform the agreed-upon repairs and services on the
specified vehicle. The Customer acknowledges that any additional
repairs or services not included in the original repair order may require
separate authorization and may incur additional costs.
- Pricing and Payment: The Customer agrees to pay OnMyWayAuto for the
automotive repairs and services provided, including parts, labor, taxes,
and any applicable fees. The final cost may vary from the initial
estimate based on unforeseen circumstances or additional necessary
repairs. Payment is due upon completion of the repairs, and the
Company may retain possession of the vehicle until payment is made
in full.
- Warranty: OnMyWayAuto provides a warranty for the repairs and
services performed, as outlined in the separate warranty document
provided to the Customer. The terms and conditions of the warranty
are governed by the warranty document.
- Customer Responsibilities: The Customer agrees to provide accurate
and complete information about the vehicle's condition and history,
including any previous repairs or modifications. The Customer is
responsible for notifying OnMyWayAuto of any changes in contact
information or other relevant details.
- Vehicle Possession and Risk: The Customer acknowledges that the
vehicle and its contents are left at OnMyWayAuto's premises at the
Customer's sole risk. OnMyWayAuto shall not be liable for any loss,
damage, theft, or unauthorized use of the vehicle or its contents while
in its possession.
- Completion Time: OnMyWayAuto will make reasonable efforts to
complete the repairs and services within the estimated time frame.
However, unforeseen circumstances or the need for additional repairs
may result in delays. The Customer acknowledges and agrees that the
completion time may be extended, and OnMyWayAuto shall not be held
liable for any resulting inconvenience or damages.
- Liability Limitation: OnMyWayAuto shall not be liable for any
indirect,
incidental, consequential, or special damages arising from the
automotive repairs and services, including but not limited to loss of
profits, data, or vehicle functionality.
- Governing Law and Jurisdiction: This Agreement shall be governed by
and construed in accordance with the laws of [Jurisdiction]. Any
disputes arising out of or in connection with this Agreement shall be
subject to the exclusive jurisdiction of the courts in [Jurisdiction].
- Severability: If any provision of this Agreement is found to be
invalid, illegal, or unenforceable, the remaining provisions shall
continue to be valid and enforceable to the fullest extent permitted by
law.
By reading these terms, the Customer acknowledges that they have read,
understood, and agreed to the terms and conditions set forth herein.
